A recent lawsuit filed in the U. S. District Court for the Northern District of California accuses Uber's management and board of directors of prioritizing profits over safety and compliance, ultimately putting the company and its shareholders at risk. The complaint, led by a Detroit pension fund, claims that Uber has consistently disregarded compliance protocols, leading to numerous lawsuits from victims of alleged sexual assault and harassment by drivers.
The lawsuit names CEO Dara Khosrowshahri and alleges that board members have breached their fiduciary duty by ignoring repeated warnings of compliance and safety failures. The plaintiffs are seeking personal compensation from Uber's leaders for the alleged harm, as well as the return of certain compensation and the implementation of stronger oversight and compliance measures. According to the complaint, the lack of compliance culture has affected not only victims of sexual assault and harassment but also customers with disabilities and consumers who have subscribed to Uber's services. Uber has responded to the accusations, stating that the lawsuit is based on misleading narratives and ignores important facts.
The company has already addressed similar lawsuits publicly and in court. This type of derivative lawsuit, where a shareholder sues the company's directors on behalf of the corporation, is not uncommon, with companies like Adobe, Apple, and Intel facing similar lawsuits this year.
