GDPR-Compliant AI

The General Data Protection Regulation requires knowing exactly where personal data is processed and by whom. On-premise AI makes the answer simple: right here, by you, and nobody else.

Why Cloud AI Creates GDPR Risk

GDPR applies to any organization processing personal data of EU residents, regardless of where the organization is based. When you send personal data to a cloud AI API, several GDPR obligations become complex:

  • Data transfer restrictions - sending data to US-based cloud providers requires Standard Contractual Clauses (SCCs) or adequacy decisions. The Schrems II ruling invalidated Privacy Shield, making US transfers legally uncertain.
  • Processor agreements - cloud AI providers become data processors under GDPR Article 28. You need a Data Processing Agreement (DPA) and must verify their compliance. Most cloud AI providers have broad, non-negotiable DPAs.
  • Right to erasure - GDPR Article 17 gives individuals the right to have their data deleted. If their data was sent to a cloud API, you must ensure the cloud provider also deletes it from logs, caches, and training data.
  • Data minimization - GDPR Article 5(1)(c) requires processing only the minimum data necessary. Cloud APIs often receive more context than strictly needed for the AI task.

GDPR fines can reach 4% of annual global turnover or 20 million euros, whichever is higher. In 2025-2026, regulators have increasingly scrutinized AI-related data processing, making compliance more urgent than ever.

How On-Premise AI Eliminates GDPR Complexity

When AI runs on your own infrastructure, within your own jurisdiction, most GDPR data transfer and processor complications disappear:

No Cross-Border Transfers

Data stays in your facility, in your country. No SCCs, no adequacy decisions, no Schrems II concerns.

No Third-Party Processors

You are both controller and processor. No DPA negotiations, no processor audits, no reliance on vendor compliance.

Simple Right to Erasure

Delete data from your database and it is gone. No need to chase a cloud provider to purge logs and caches.

Data Minimization Built In

You control exactly what data reaches the AI model. No unnecessary context sent to external systems.

Full Data Sovereignty

Personal data never leaves your legal jurisdiction. Complete control over processing, storage, and retention.

Transparent Processing

You can show regulators exactly where and how data is processed. Complete audit trail under your control.
