California Gas Stations Face Lawsuit Over Alleged AI-Driven Price Manipulation

A recent lawsuit filed in the Eastern District of California accuses several major gas station operators of using AI-driven pricing software to inflate fuel prices. The lawsuit targets over 1,700 gas stations across the state, including well-known brands such as BP, Walmart, and 7-Eleven. According to the complaint, the gas stations used a pricing tool from Kalibrate Fuel Systems that allegedly analyzed competitor data to influence fuel costs, resulting in prices that were approximately 30 cents per gallon higher than they would have been under normal competitive conditions. The plaintiffs argue that this constitutes an 'illegal algorithmic price-fixing scheme' orchestrated by Kalibrate and the gas retailers.

California has the highest average gas prices in the country, making even small price increases significant for drivers. The lawsuit claims that the gas companies violated California law AB 325, which aims to prevent algorithmic price fixing. The California Energy Commission's Division of Petroleum Market Oversight has warned fuel refiners, distributors, and sellers about the new law, emphasizing the importance of complying with its provisions. The suit seeks compensatory damages and triple the amount of damages caused, although it does not specify a dollar amount.

This case highlights concerns over the use of AI-driven pricing tools and the potential for surveillance pricing, where companies use personal data to determine prices. As the lawsuit progresses, it may have significant implications for the use of AI in pricing strategies and the protection of consumer rights.
