California Gas Price Inflation Sparks Class-Action Lawsuit Against AI Pricing Software

A recent class-action lawsuit filed in California's Eastern District federal court alleges that an AI-powered fuel pricing software, Kalibrate Fuel Pricing, has contributed to inflated gas prices in the state. The lawsuit names the software's manufacturer, Kalibrate, and about a dozen gas station operators that use the tool, as well as unnamed companies that also utilize the software. The plaintiffs claim that the software enables gas stations to collude and set artificially high prices, resulting in a 4. 5 percent increase in fuel costs.

Kalibrate's software collects and analyzes non-public pricing and sales data from participating stations, allowing them to set competitive prices. However, the lawsuit alleges that this practice constitutes anti-trust violations, particularly under California's recently amended Cartwright Act. The amendment, which took effect on January 1, 2026, specifically addresses the use of common pricing algorithms. The plaintiffs argue that Kalibrate's software facilitates cooperative price adjustments among gas stations, leading to higher prices for consumers.

With California already bearing the highest gas prices in the country, partly due to high state taxes, the lawsuit highlights the significant impact of even small price increases on fuel costs. For instance, a one-cent increase in prices would result in an additional $134 million in annual fuel costs for California consumers. The lawsuit also accuses Kalibrate of sharing proprietary pricing information with prospective clients, further solidifying the allegations of anti-competitive practices. As the case unfolds, it will be important to monitor the implications of AI-powered pricing software on consumer costs and the role of regulatory measures in preventing anti-trust violations.
