Governor Gavin Newsom signed an executive order Monday that will reshape how California does business with artificial intelligence firms. The directive requires the state to craft new procurement standards within four months, placing specific obligations on vendors.
Companies bidding for state contracts must demonstrate clear policies to prevent their AI systems from disseminating child sexual abuse material or violent pornography. They are also mandated to outline how their models address harmful bias and to detail safeguards against unlawful discrimination, surveillance, and detention. The order further instructs state agencies to develop best practices for watermarking AI-generated or altered media.
Newsom framed the move as a continuation of California's dual role as both tech innovator and policy leader. "We’re going to use every tool we have to ensure companies protect people’s rights, not exploit them," he stated.
This action positions California against a federal push for lighter oversight. A national AI policy framework issued by the White House in December explicitly discouraged states from enacting their own regulations, arguing that "excessive state regulation thwarts" the imperative for U.S. companies to innovate freely. That framework also directed the Justice Department to form a task force to legally challenge state-level AI rules.
California's order is part of a broader trend. According to a New York Times tally, states have enacted over 100 laws aimed at areas like protecting children from chatbots and preventing the unauthorized use of copyrighted material to train AI models. The debate now centers on whether a patchwork of state laws or a unified federal approach will define the future of AI governance.
