Anthropic has taken the U.S. government to court, seeking to overturn a Pentagon decision that labels the AI company a national security supply chain risk. The lawsuit, filed Monday in California federal court, marks a significant escalation in the firm's dispute with the Trump administration over restrictions on how its AI can be used.
The company argues the designation, announced by Defense Secretary Pete Hegseth on February 27, is unlawful and violates its constitutional rights. The move followed months of failed negotiations where Anthropic refused to remove guardrails blocking its Claude AI from being used for autonomous weapons or mass domestic surveillance. The administration insists it requires full flexibility for any lawful military application.
This legal battle places a spotlight on the fraught relationship between AI developers and the government over ethical boundaries in warfare and surveillance. The designation immediately restricts Anthropic's defense-related work, using an authority typically reserved for foreign adversaries. In a separate filing in a Washington, D.C. appeals court, the company also challenges an order for federal employees to stop using Claude.
Anthropic CEO Dario Amodei maintains the penalty is narrow, affecting only Pentagon contractors using Claude for defense projects. He emphasizes that the vast majority of the company's business - projected at $14 billion this year - with other government agencies and corporate clients remains unaffected. The outcome of this case could set a precedent for how AI firms negotiate the limits of their technology's military applications.
While Anthropic states it remains open to a settlement, the Pentagon has declined to comment on ongoing litigation.
